Permission of Property Owner

Fire permits are only available to property owners or renters/tenants who have been given written permission to apply for a permit. Renters/Tenants must be able to produce this written permission if asked by an officer. If this documentation cannot be provided to the officer the permit will be considered invalid.

Fire Permit Conditions

General Conditions

  1. This Permit is only valid between two hours before sunset and two hours after sunrise local time on any day.
  2. The Permittee or person in charge shall be present at the site of the burning operation conducted under the Permit until extinguishment.
  3. The Permittee, in the opinion of an Officer, shall have sufficient resources available to maintain control of the fire at all times.
  4. The Permittee shall have at the site of the burning operation a valid Fire Permit and shall produce and show the Permit to any Officer upon request.
  5. The Permittee assumes full responsibility for the burning operation conducted under the Permit.
  6. The Permittee shall have at the location of the fire, at least one person and serviceable firefighting equipment as follows: Shovel, rake, water source
  7. No burning if winds exceed 15 km/hr;
  8. A Fire Permit shall be nullified if a Restricted Fire Zone is declared.

Fire Season is April 1 to October 31, subject to extension.

A Fire Permit is required before starting a fire outdoors during the Fire Season, except as provided in Regulation 207/96 under the Forest Fire Prevention Act and no other heat/cooking source is available.

A Fire Permit may be revoked at any time in the absolute discretion of an Officer.

No person shall start a fire outdoors unless:

  1. the person is burning piled clean wood or wood by-products, brush or leaves;
  2. the fire is started not earlier than two hours before sunset, and is extinguished not later than two hours after sunrise the following day, or earlier;
  3. the person ensures all conditions will allow the fire to burn safely from start to extinguishment;
  4. the fire is at least five metres from any forest or woodland; and
  5. the fire is at least three (3) metres from any flammable materials.

Penalties

Any person who contravenes any provision of By-Law No. 38-2018 is guilty of an offence and, upon conviction, is liable to a penalty as provided in the Provincial Offences Act.

Any person who contravenes any provision of this By-Law or any Order made thereunder or any condition of a permit issued thereunder may be liable for all damages to public and/or private property caused by the fire and may also be liable for the full cost of extinguishing the fire.

Choose a Permit Type


Annual Permit - $40

This type of permit allows a fire less than 0.7m x 0.7m x 0.7m in size consisting of leaves, needles, clean wood and wood by-products. This permit is valid for the length of the fire season.

Specific Conditions for Annual
No person shall use an Annual Fire Permit except for the following:

  • campfire burned in a single pile no larger than 0.7 m by 0.7 m in diameter by 0.7 m high.
  • Commercial fire pots (ex. Chimineas) no larger than 0.7 metres by 0.7 metres in diametre by 0.7 metres high.

Level 1 Permit (4 day permit) - $10

This type of permit allows a fire less than 2m x 2m x 2m in size for the purposes burning grass or debris. This permit is valid for 4 days beginning on the date of application.

Specific Conditions for Level 1
No person shall start or tend a fire outdoors for the purpose of burning grass or leaf litter unless:

  • the total are to be burned does not exceed 0.1 ha (1/4 acre);
  • a responsible person is available to tend to the fire until it is extinguished; and
  • the length of the flaming edge does not exceed fifteen (15) metres (50 ft).

Level 2 Permit (Incinerators) - $50

This type of permit allows a fire that exceeds the specific conditions of the annual and level 1 permits, or allows for the operation of an incinerator. An inspection is required. This permit is valid for 4 days beginning on the date of issuance except in the case of an incinerator which is valid for the fire season.

Specific Conditions for Level 2
No person shall operate an outdoor incinerator unless:

  • the person is burning clean wood or wood by-products, brush or leaves;
  • the incinerator is an enclosed device constructed entirely of non- combustible material;
  • the incinerator is at least five (5) metres from any forest or woodland;
  • the incinerator is at least three (3) metres from any flammable materials;
  • the outlet of the incinerator is covered with a screen having a mesh size of not more than 6mm; and
  • the person who starts a fire in an incinerator shall ensure that a responsible person monitors the fire until it is extinguished.
  • Daytime burning may be approved by inspector at thier discretion.
